Welcome to 39DollarSocial.com. By accessing our website and purchasing our services, you agree to be bound by the following Terms and Conditions ("Terms"). Please read them carefully. If you do not agree with these terms, you should not use our services.

These Terms apply to all clients, visitors, and users of 39DollarSocial.com.

2. Service Definitions & Scope

2.1 Social Media Management

  • Scope: Our social media packages include content creation, caption writing, and scheduling based on the plan selected (e.g., 3 posts/week or daily posting).
  • Approvals: All content is scheduled for auto-posting. It is the Client’s responsibility to review content. If no feedback is provided within 48 hours of content delivery, it is deemed approved.
  • Access: You agree to provide us with the necessary access rights (admin/editor) to your social media accounts. We are not responsible for accounts being banned or restricted due to platform algorithm changes or prior account history.

2.2 Website Design (Website-as-a-Service)

  • Ownership: Unlike traditional web design agencies where you pay upfront, our "Pay Monthly" model is a lease-to-own or subscription service. 39DollarSocial.com retains ownership of all code, designs, and assets until 24 months of continuous payments have been made, or a buyout fee is paid.
  • Hosting: Your monthly fee covers hosting and maintenance. If you cancel your subscription, your website will be taken offline unless a migration fee is paid.
  • Content Updates: "Unlimited small edits" refers to text and image swaps. It does not include structural redesigns, new page creation, or custom coding features, which are billed separately.

2.3 Custom Software & Automation

  • Scope: Custom software projects (e.g., Internal Tools, Apps) are scoped in a separate Statement of Work (SOW).
  • Maintenance: Monthly fees for software cover server hosting and API maintenance. They do not cover new feature development.
  • Data: You own your customer data (leads, inventory lists, etc.) 100%. We own the underlying code framework unless a full buyout is negotiated.

3. Payments, Billing, and Cancellations

3.1 Recurring Billing

Authorization: By purchasing a plan, you authorize 39DollarSocial.com to charge your credit card or payment method automatically every month on the anniversary of your sign-up date.

Payment Gateway: Payments are processed securely via third-party gateways (e.g., Stripe/PayPal). We do not store your credit card information on our servers.

3.2 Cancellation Policy

  • No Long-Term Contracts: You may cancel your social media or maintenance subscription at any time.
  • Notice Period: We require 30 days' written notice via email (support@39dollarsocial.com) to cancel services. This allows us to offboard your account and stop future work.
  • No Partial Refunds: We do not offer prorated refunds for partial months. If you cancel, your service will continue until the end of the current billing cycle.

3.3 Late Payments

If a payment fails, we will attempt to retry the charge. If payment is not received within 7 days, services (including website hosting and social posting) will be suspended immediately. A reactivation fee of $25 may apply.

4. Refund Policy

  • Social Media & Maintenance: Due to the nature of labor-intensive digital services, we do not offer refunds once work has commenced (e.g., content has been created or the month has started).
  • Web Design Setup Fees: Setup fees covers the initial labor of setting up your environment and are non-refundable once the project onboarding form is submitted.
  • Satisfaction: If you are unhappy with a piece of content, we offer unlimited revisions until it is approved, provided the request is within the original scope.

5. Limitation of Liability

39DollarSocial.com shall not be liable for:

  • Platform Changes: Changes to third-party platforms (Facebook, Instagram, Google, etc.) that affect your reach, engagement, or functionality.
  • Account Suspensions: We follow best practices, but we are not liable if a social media platform suspends or bans your account.
  • Loss of Profit: We do not guarantee specific results (e.g., a specific number of leads, sales, or followers). Marketing results vary by industry and offer.
  • Third-Party Tools: Any downtime or data loss caused by third-party hosting providers, API failures, or software glitches.

6. Intellectual Property

  • Client Materials: You retain ownership of all logos, images, and branding assets you provide to us. You guarantee that you have the right to use all materials provided.
  • Deliverables: Upon full payment, you are granted a license to use the social media graphics and content created by us for your business marketing.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
